Terms of Service

1. Acceptance of Terms

By accessing or using the DMD HUB website (hub.dmdnavigation.com) and/or the DMD HUB mobile application (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

The Service is operated by DMD Navigation Lda, a company registered in Portugal ("we", "us", "our").

2. Eligibility

You must be at least 16 years of age to use the Service. By creating an account, you represent that you meet this requirement. If you are under 18, you must have parental or guardian consent.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized use of your account.
• One person may not maintain multiple accounts.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

"User Content" means any content you submit, upload, or share through the Service, including posts, comments, photos, GPX files, location data, group messages, and profile information.

• You retain ownership of your User Content.
• By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content within the Service.
• You represent that you have the right to share any content you submit and that it does not infringe any third party's rights.
• We may remove User Content that violates these Terms without notice.

5. Acceptable Use

You agree not to:

• Post content that is illegal, harmful, threatening, abusive, defamatory, or discriminatory.
• Upload malware, viruses, or malicious code.
• Spam, harass, or impersonate other users.
• Attempt to gain unauthorized access to other accounts or our systems.
• Use the Service for commercial advertising without permission.
• Scrape, crawl, or automatically collect data from the Service.
• Share false or misleading location data that could endanger riders.
• Upload GPX files or location data that you do not have the right to share.
• Circumvent any access restrictions or security measures.

6. Riding Groups & Location Sharing

• When you join a riding group, your real-time location may be visible to other group members.
• You can leave a group at any time to stop sharing your location.
• Group owners and administrators can moderate content and manage members.
• We are not responsible for how group members use shared location data.
• Location data shared in groups is for informational purposes only and should not be relied upon as a safety system.

7. GPX Files & Route Data

• GPX files you upload remain your property.
• Files marked as "Public" are available for other users to view and download.
• Route calculations are provided by third-party routing services and may not be accurate. Always use your own judgment when riding.
• We are not responsible for the accuracy or safety of any route data shared on the Service.

8. DMD2 Integration

The Service may interact with DMD2 navigation devices and the DMD2 application. We are not responsible for any issues arising from the use of third-party hardware or software. Navigation destinations sent from the Service to DMD2 are provided as a convenience and should always be verified by the rider.

9. Content Moderation & Reporting

• We reserve the right to review, moderate, and remove any User Content.
• Users can report content that violates these Terms using the "Report" feature.
• Reported content is reviewed by our team. We may unapprove or remove content and take action against the responsible account.
• Repeated violations may result in account suspension or permanent ban.

10. Intellectual Property

The Service, including its design, code, logos, and original content, is owned by DMD Navigation Lda and is protected by copyright and intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• The Service will be uninterrupted, error-free, or secure.
• Route data, location information, or maps will be accurate or complete.
• User-submitted content is accurate, safe, or reliable.

12. Limitation of Liability

To the maximum extent permitted by applicable law, DMD Navigation Lda shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to, damages arising from reliance on route data, location information, or navigation instructions provided through the Service.

Motorcycle riding is inherently dangerous. The Service provides tools for planning and sharing routes, but you are solely responsible for your safety on the road. Always ride within your abilities and obey local traffic laws.

13. Account Termination

• You may delete your account at any time from your account settings.
• We may suspend or terminate your account for violations of these Terms.
• Upon termination, your personal data will be deleted in accordance with our Privacy Policy.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Portugal. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Porto, Portugal, without prejudice to any mandatory consumer protection laws that may apply in your jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. We will notify users of significant changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
